Placing a tiny house in Flanders: how the legislation works

You want to place a tiny house in your garden, next to your parents' house or on your own property in Flanders.

But when do you need a permit? When exactly not?

And what about a renovation or care home?

Flanders does not have a separate legal framework for tiny houses like Wallonia does. Instead, there are a number of existing regulations within Flemish urban planning law that you can cleverly use, depending on your situation. In this article, we clarify everything, from your perspective as a future tiny house dweller.

The basic rule: a tiny house on wheels is movable property.

A tiny house on wheels with caravan homologation is legally considered movable property in Flanders, similar to a caravan or a movable dwelling unit. This is a crucial distinction, as it opens the door to a number of specific exceptions from the permit requirement.

At Tiny Wonder, the tiny houses often have European caravan homologation. This not only makes them unique in Europe but also has direct implications for how Flemish legislation applies to them.


When do you not need a permit?

Less than four months to publish: Article 7.2 Exemptions Decree

This is the most common arrangement for temporary use. Anyone placing a tiny house for less than four consecutive months is exempt from urban planning permits. This exemption applies in a wide range of zones in the spatial plan:

  • Residential areas
  • Farmland
  • Industrial estates
  • Recreational areas
  • And a number of other destination zones

Practical: a tenant who places their tiny house for three months during a renovation or a temporary life situation generally does not need a permit. After four months, the exemption expires and the tiny house must be moved, or a permit must be applied for.

Renovation: exempt for up to two years

Are you renovating? Then there's a specific scheme for you:

  • Without a permit for the renovation: You may place a tiny house next to your dwelling for a maximum of one year.
  • With a licensed renovation: The term runs for up to two years.

This is the most common situation for our tenants: people who are thoroughly renovating their homes and temporarily living in a tiny house in their own garden or on their own plot. This way, you stay close to the works, which improves the efficiency and progress of the works.

Care living: tiny house next to your family

Living in a care home in a tiny house is possible in Flanders via a notification procedure, without needing a full environmental permit. You then place a care home next to your existing home to provide or receive care.

Point of attention: the current Flemish care home scheme is linked to an age limit (65+) or care need.

When do you need a permit?

As soon as you wish to stay in the same location with a tiny house for longer than four months, and your situation falls outside the renovation exception or the care home arrangement, then you essentially need a building permit.

How the licence is assessed depends on:

  • The plot's destination zone
  • The local municipal urban planning regulation
  • The specific characteristics of your location and project

Every municipality has a certain amount of discretion. In practice, we see differences: some municipalities are constructive, others rather reserved. A well-founded application makes the difference.

Can I register my residence in a tiny house in Flanders?

A tiny house on wheels is considered movable property, and the Flemish Housing Decree does not permit the registration of movable property as a primary residence if the tiny house is not. .

There is a way out: via a reference address, you can unofficially establish yourself without formal domicile registration. In practice, many tiny house tenants arrange things this way.

If you buy a tiny house and place it on a licensed building plot with the necessary environmental permit, then direct debit can be requested in Flanders.


Recreational use: B&B, glamping and holiday rentals

Do you want to use a tiny house as an extra guest unit for a B&B or glamping site in Flanders? Then a separate regulatory track applies, namely that of the accommodation decree.

The main points:

  • Your tiny house must be registered as tourist accommodation.
  • Specific fire safety requirements apply
  • The location must be suitable for tourist exploitation.

Does your use fall under the four-month rule, the renovation exemption, or assisted living? If so, the thresholds are low.

Step 2: Check the destination of the plot

Enquire with your local council about the zoning plan and the applicable urban planning regulations.

An informal preliminary consultation with the Urban Planning department saves time and surprises.
